Matthew Harvey KC

Matthew Harvey KC is an experienced and highly regarded arbitrator. He is one of Australia’s leading Admiralty and maritime counsel.

Matthew has experience in conducting ad hoc commercial arbitrations under the SCMA, SIAC, ACICA, Resolution Institute, UNCITRAL, MLAANZ, and other international rules.

He has been appointed in arbitrations in the Asia-Pacific Region, involving charterparties, carriage of goods by sea, international sale of goods, defective infrastructure, commercial partnership, financing commodities, and the aviation industry.

He has published and spoken extensively on arbitration, maritime law, and other areas of commercial law.

He is based in Melbourne and Sydney and travels to other countries for appointments.

Appointments

Matthew has given numerous awards, including, on the merits (liability and damages), costs, and interim measures. He has arbitrated disputes subject to the law of Singapore, England, China, and Australia.

Claim brought by lender against borrower under a commodities financing agreement.

Interpretation of a contract between parties in the aviation industry.

Infrastructure dispute regarding calculation of losses and entitlement to damages.

Charterparty dispute involving the detention of a vessel in a foreign port.

Claims as to misleading or deceptive conduct under a salvage agreement.

Recognitions

Matthew is recognised as one of Australia’s leading counsel in the areas of shipping and maritime law (Chambers Asia Pacific since 2015, Best Lawyers since 2012, Who’s Who Legal since 2017, and Doyle’s Guide since 2010). Doyle’s Guide (2020) lists him as pre-eminent senior counsel in Australia.

Chambers Asia Pacific (2021) says that Matthew ‘wins praise from sources, not only for bringing “a deep intellect to his analysis of any maritime matter”, but also for “his ability to communicate unique and complex maritime law issues to clients and judges who are less familiar with the area”. This latter observation may be linked to others which describe him as “extremely good on his feet in court,” “confident and convincing when presenting an argument” and “excellent at getting to the heart of a complex matter and determining the key issues that will decide the case”.’

Who’s Who Legal (2020) says that Matthew ‘is widely acknowledged as one of Australia’s leading barristers on shipping and maritime law known for his excellent work in domestic and international arbitration and litigation’.
